The Michigan Vehicle Code sets the elements and penalties, and the charging decision often depends on injury, death, or prior record. For example, fleeing and eluding escalates by degree, and the statute provides felony penalties up to 15 years when the violation results in death. MCL 257.602a(5).

Michigan’s “stop and identify” requirements can apply even in single-vehicle accidents, and a person can be “involved” in an accident without being the cause. People v Otto, 348 Mich App 221, 233–34, 249–51 (2023). In hit and run cases involving death, jury instructions require the jury to find beyond a reasonable doubt both causation and death as elements when the statute demands it. People v Dumback, 330 Mich App 631, 647 (2019).
