Rea in discussing the “within this state” language as a jurisdictional element. These details become important when an OWI is alleged in a private parking area, a roadway near jurisdictional boundaries, or where the record is imprecise.

Impairment evidence is also contestable. Field sobriety tests are not infallible and can be affected by injury, anxiety, fatigue, footwear, lighting, and the way instructions were delivered. Video is often the best neutral witness. When the video undermines the claimed “clues,” it becomes harder for the prosecution to meet its burden beyond a reasonable doubt.

Chemical testing challenges involve both law and science. Issues can include lawful authority for obtaining the sample, compliance with observation and collection rules, instrument performance, and how the result relates to the time of driving. Cases such as McNeely and Birchfield, and Michigan decisions applying those principles, provide a legal framework for challenging unlawful testing and overbroad justifications.
