The best answers are concrete, including timelines, document requests, and decision points, not marketing phrases. Also ask how the lawyer maintains communication, and who will appear in court, the lawyer you hire or an associate.
Finally, ensure the strategy accounts for timing and prejudice. Michigan’s speedy-trial doctrine uses a four-factor balancing analysis and can result in dismissal when the constitutional right is violated. People v Williams, 475 Mich 245, 261 (2006); see also MCR 6.004(A). A lawyer who manages both speed and substance, and who builds a record, is usually the one who can negotiate from strength.
You should also evaluate whether the lawyer can explain, in plain language, the specific hearings and rules that will govern your case. For felonies, ask how counsel approaches the preliminary examination, whether counsel expects to contest bindover, and how counsel uses the record for later motions. For any case type, ask how counsel evaluates suppression issues and what information counsel needs from you to do that work. The lawyer’s willingness to provide a written plan, including expected deadlines and next steps after each hearing, is often a better indicator of quality than general assurances. A process-driven plan is what converts a consultation into effective representation.
In close cases, a short written brief filed early, supported by rules, statutes, and record citations, often does more than oral argument alone, because it anchors the judge’s decision in a stable legal framework.
