The state still must prove operation and intoxication under the relevant subsection, and those elements often depend on the lawfulness of the stop and arrest and the reliability of the impairment evidence.
The defense should scrutinize how the state intends to prove intoxication. If the case relies on field sobriety tests, video review and careful cross-examination are crucial. If the case relies on chemical testing, counsel should focus on lawful acquisition, procedure, and whether the test record supports the state’s interpretation.
