In practice, causation disputes often turn on reconstruction methodology, whether the alleged impairment actually contributed to the collision, and whether an intervening factor broke the causal chain.
The underlying impairment proof is also litigable. The prosecution may rely on field sobriety tests, officer observations, and chemical testing. Each category has vulnerabilities. Field tests can be affected by injury or stress, and chemical testing requires lawful acquisition and reliable methodology. Where blood testing is at issue, the legal background includes warrant requirements and the limits on warrantless blood draws.
