If the client is eligible for a diversionary or deferred option, counsel should evaluate whether the court and prosecutor will require admissions, testing, or treatment, and how those requirements will appear on the public record.
In close cases, a short written brief filed early, supported by rules, statutes, and record citations, often does more than oral argument alone, because it anchors the judge’s decision in a stable legal framework.
